Terms & Conditions

1. Definitions

• Service – the web/mobile platform that lets users create AI‑generated e‑books, audio‑books and printed books.
• Content – any text, image, audio, prompt or other material uploaded to or generated by the Service.
• Credits – pre‑paid units redeemable for generation tasks.

2. Acceptance & Scope

(a) You accept these T&C by ticking “I agree to the Terms & Conditions and Privacy Policy” on sign‑up and again each time you press Generate.

(b) These T&C apply to all use of the Service within the EEA and, where Section 15 applies, the United States.

3. Eligibility & Accounts

(a) You must be 18 years old—or 13‑17 with verified parental consent—to open an account. Children under 13 may participate only through a parent‑managed account.

(b) You are responsible for safeguarding your credentials. Mythoria is not liable for unauthorised use that results from your failure to protect them.

4. Service Description & Updates

The Service lets you input a prompt or dictation and—via Google Vertex AI and OpenAI models—generates an e‑book, optional audio‑book and (where available) a printed copy. Output is automatically labelled “Generated by AI”.

We will keep the Service in conformity with the contract and provide necessary security or functionality updates as required by Directive (EU) 2019/770.

5. Intellectual‑Property Rights

(a) Your ownership. As between you and Mythoria, you own all rights in the AI‑generated output.

(b) Licence to Mythoria. You grant Mythoria a worldwide, non‑exclusive, royalty‑free licence to store, process and display your Content solely to operate the Service and—if you expressly opt in—to showcase your finished book.

(c) Warranties & indemnity. You warrant that your inputs do not infringe third‑party rights or applicable law and you will indemnify Mythoria against related claims.

6. Credits, Pricing & Refunds

(a) Prices are shown in euros and include the reduced Portuguese VAT rate of 6 % applicable to e‑books.

(b) You have 14 days to withdraw from a credit purchase under Decreto‑Lei n.º 24/2014, but you expressly request immediate performance and acknowledge the right is lost once generation begins.

(c) Failed generations automatically credit your account; monetary refunds apply only where non‑conformity under Directive 2019/770 is proven.

(d) Mythoria issues e‑invoices that comply with Portugal’s rules (PDF invoices treated as electronic until 31 Dec 2024).

7. Content Policy & Moderation

(a) Prohibited: illegal, defamatory or sexual content involving minors.

(b) Notice‑and‑action: Mythoria provides an online form and abuse@ address; valid notices of illegal content are reviewed within 24 h in line with DSA Art 16.

(c) Repeat infringers may have accounts suspended after three valid takedowns within 12 months.

8. AI‑Specific Disclosures

(a) Outputs are machine‑generated; factual errors may occur; no output constitutes professional advice.

(b) Mythoria publishes or links to provider‑supplied summaries of copyrighted training data annually, fulfilling AI Act transparency duties.

9. Data Protection

(a) Processing of personal data is explained in the separate Privacy Notice.

(b) Children’s accounts default to high‑privacy settings in line with the ICO Age‑Appropriate Design Code.

(c) Source images/voice are retained for two years, then automatically deleted.

10. Warranty, Service Level & Liability

(a) Mythoria targets 99 % monthly uptime but offers no SLA for beta features.

(b) We are not liable for failures caused by events beyond our reasonable control, including upstream AI outages.

(c) Except for intent, gross negligence, death or personal injury, Mythoria’s aggregate liability is capped at three (3) times the fees you paid in the preceding 12 months.

11. Printed Books

Defects in printed copies fulfilled via our print partner will be remedied by a free replacement copy shipped at Mythoria’s cost.

12. Changes to These T&C

Material changes will be notified by e‑mail 30 days in advance. If you object, you may cancel unused credits for a pro‑rata refund.

13. Governing Law & Dispute Resolution

(a) These T&C are governed by Portuguese law, courts of Vila Nova de Gaia having exclusive jurisdiction.

(b) Consumers may also use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr) while it remains operational.
